Terms & Conditions

These T&Cs apply to

  • the use of the services and access to this website, and
  • any other related agreement or legal relationship with the provider, in a legally binding way. Defined terms are listed in the relevant section of this document.

Users are requested to read this document carefully.

  1. Scope
  1. These T&Cs apply to the use of this website, the member area, and to all contracts made through it between the provider and clients (consumers and entrepreneurs).
  2. Differing terms and conditions of clients do not apply unless the provider agrees in writing.
  3. Access is only permitted to persons of legal age according to applicable law.
  1. Services
  1. Online services: 1:1 sessions, live online workshops, recordings of workshops, digital products with an expiration date, online courses.
  2. All offerings are digital/online. Unless otherwise stated, course/product access is limited to a maximum of 6 months.
  1. Contract Formation
  1. Product purchases are made via ThriveCart/Stripe; 1:1 sessions via Acuity/Stripe.
  2. The depiction of services is non-binding. By sending the order you make an offer; the contract is concluded with the automatic order confirmation.
  3. Access/download is provided automatically after payment is received (member area via LearnDash; live formats, e.g. via Zoom).
  1. Prices & Payment
  1. Final prices include taxes.
  2. Payment is due immediately upon booking via Stripe (credit card, SEPA, EC).
  3. Currently no installments / payment plans.
  4. Chargebacks: In the case of unjustified chargebacks, the provider is entitled to block access until clarification and charge the costs incurred.
  1. Cancellation & Withdrawal

Right of withdrawal for consumers

  1. Generally 14 days from contract conclusion.
  2. Digital content / online courses: Right of withdrawal expires early if you explicitly agree that execution begins before the end of the period, and you confirm that you are aware of the loss of the right of withdrawal (checkbox at checkout).
  3. 1:1 Sessions: Free cancellation up to 72 hours before the appointment; after that 100% due. Rescheduling is possible (subject to availability) up to 72 hours before.
  4. Retreats / Offline Events (if offered): Up to 30 days prior free of charge; 29-14 days: 50 %; from 13 days before / no-show: 100%. Replacement participation may be arranged by agreement.
  1. Use of Website & Member Area
  1. An account may be required to use certain parts; login credentials must be treated confidentially.
  2. Account is personal and must not be shared with third parties.
  3. The provider may suspend or delete accounts for violations; payment claims remain unaffected.
  4. Creating user accounts by bots or automated procedures is prohibited.
  1. Online Workshops, Group Offers & Recordings (Zoom)
  1. Delivery: Online workshops and group sessions are usually conducted via Zoom. By booking you consent to using Zoom.
  2. Recording & Provision: Events may be recorded and made accessible to participants via the program/member area (for a limited time according to program duration). If you enable audio/video, you may be seen / heard in recording; chat contributions may be captured.
  3. Usage Rights / Publication: You grant the provider a simple right (non-exclusive) for the duration of the program to use recordings of your image / voice (if activated by you) for internal documentation and provision within the program/member area. External publication (outside the program) only with your separate agreement.
  4. Options to protect privacy: You may participate with camera/microphone off and use a display name without full name. If you do not wish to appear in recording, use these options and avoid personal details in chat. You can inform beforehand if sensitive topics are to be discussed; provider will strive for suitable solutions (e.g. pausing recording).
  5. Confidentiality: Content from group formats is confidential. Participants commit to not sharing personal information of others outside the event (no recordings / screenshots / forwarding).
  6. Data protection notes for Zoom: Depending on use, personal data (e.g. name/display name, IP address, device data, audio/video, chat content) is processed and there may be data transfer to third countries (including USA). A data processing agreement (Art. 28 GDPR) has been concluded with Zoom; Zoom uses standard contractual clauses (SCC) among others. More details in Privacy Policy.
  1. Copyright

All content (texts, audio, videos, worksheets, etc.) is protected by copyright. Use is only allowed for personal, non-commercial purposes. Reproduction, distribution, sale, publication or licensing without prior written consent are prohibited. Legal limitations remain unaffected.

  1. Participation Conditions, Obligations & Distinction to Psychotherapy
  1. Participation is done in personal responsibility. In all formats respectful conduct is required; disturbances can lead to exclusion.
  2. No guarantee of success. Offerings do not replace medical/psychological/therapeutic treatment.
  3. Obligations of the client: Coaching, 1:1 Sessions, Workshops and Group Offers are based on cooperation and personal responsibility. The client commits to provide truthful information, to participate actively (e.g. in exercises, tasks between sessions), to be punctual, to ensure technical prerequisites (working device, stable internet connection, undisturbed environment), and to share relevant information in good time. The provider accompanies the process; the work of change is performed by the client.
  4. Distinction from psychotherapy: Coaching & ancestral work are not psychotherapy and are directed at mentally stable, capable persons. While psychotherapy serves to treat mental illnesses and often focuses on past and symptoms, coaching & ancestral work are solution- and future-oriented. If there are existing or suspected mental illnesses, please consult medical or psychotherapeutic professionals. See also contraindications in the Terms of Use / Appendix.
  1. Liability & Disclaimer
  1. The provider is liable for intent and gross negligence. In case of simple negligence the provider is only liable for breach of essential contractual obligations (“cardinal obligations”), but limited to foreseeable, contract-typical damage. Liability for indirect damage, loss of profits, or savings not achieved is excluded.
  2. The provider gives no guarantees or promises about specific outcomes.
  3. Liability disclaimer: The provider is not a physician, alternative practitioner, or psychotherapist, and does not make diagnoses. None of the offered services or products replaces medical, psychological or psychotherapeutic treatment or advice. No healing promises are made. Participation in all offerings is at one’s own responsibility.
  4. Liability for damages to life, body or health remains unaffected. Also liability under mandatory statutory provisions remains.
  1. Reservation of Ownership & Use Rights Until Payment
  1. Until full payment is received, no usage rights for digital content are granted; provided access may be restricted until then.
  2. After full payment, the client receives the simple, non-transferable right to personal use in accordance with § 8 of these T&Cs.
  1. Service Interruptions & Force Majeure
  1. The provider reserves the right to temporarily suspend access to services due to maintenance, security updates or technical changes.
  2. Events beyond provider’s control (force majeure, e.g. power failure, internet outage, server disruptions by third parties such as Zoom or Stripe) release the provider from performance obligations for the duration of the disruption.
  3. Temporary interruptions do not give rise to claims for damages or reduction by clients.
  1. Permissible Use
  1. The website and services may be used only for the intended purposes.
  2. Any unlawful, abusive or security-endangering use is prohibited.
  3. In case of violations the provider is entitled to block access or terminate the contract without notice.
  1. Resale / Reselling Prohibition

The paid or unpaid resale of access, licenses, course or workshop seats, as well as any form of reselling without prior written consent of the provider is prohibited.

  1. Amendment Reservation
  1. The provider is entitled to adjust services and content, insofar as this serves to preserve or improve the offering.
  2. Amendments to the T&Cs will be communicated to clients prior to becoming effective. If the client does not object within 14 days, amendments are considered accepted.
  1. Data Protection

Information on the processing of personal data can be found in the Privacy Policy on this website.

  1. Assignment

The provider may transfer rights and obligations under the contractual relationship taking into account legitimate interests. Assignment by clients requires the provider’s prior written agreement.

  1. Applicable Law & Jurisdiction
  1. The law of the US State of Wyoming applies, to the exclusion of its conflict-of-law rules.
  2. For consumers residing in the European Union, the mandatory consumer protection law of their country of residence applies in addition.
  3. The place of jurisdiction for all disputes arising from or related to these T&Cs and contracts concluded under them is Lisbon, Portugal, provided the client is an entrepreneur or has no general place of jurisdiction in the European Union.
  4. For consumers within the EU, statutory place of jurisdiction of their place of residence remains unaffected.
  1. Severability Clause

Should individual provisions be invalid, the validity of the remaining provisions remains unaffected. Invalid provisions will be replaced, as far as legally permissible, by provisions that most closely achieve the economic purpose.
